Trade Wzrd Terms of Service

By accessing or using Trade Wzrd ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.


1. Description of Service

Trade Wzrd is a trade automation platform that executes trades on your brokerage accounts via API, processes webhooks from TradingView and other sources, provides position sizing and risk management tools, and offers trade analytics and reporting.

What Trade Wzrd is NOT:

  1. - NOT a broker or financial institution

  2. - NOT a trading advisor or signal provider

  3. - NOT a financial advisor or investment advisor

  4. - NOT responsible for your trading decisions

  5. - NOT a guarantee of trading profits

2. Account Registration and Eligibility

  • To use Trade WZRD, you must:

  • Be at least 18 years of age and have legal capacity to enter into contracts.

  • Provide accurate and complete registration information.

  • Have legitimate access to the trading accounts you connect.

  • Maintain the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your account, including unauthorized access due to your negligence. Notify us immediately of any security breach at support@tradewzrd.com.

  • You may not create multiple accounts to abuse the free plan or evade bans.

3. Prohibited Uses and User Responsibilities

  • You may NOT use Trade WZRD to:

  • Violate any laws or regulations.

  • Trade on accounts you don't own or have permission to access.

  • Manipulate markets or engage in fraudulent trading.

  • Abuse, harass, or threaten other users or our staff.

  • Reverse engineer, decompile, or hack the Service.

  • Use automated bots to create accounts or abuse the platform.

  • Resell or redistribute access without authorization.

  • Intentionally overload or damage our infrastructure.

  • You are responsible for complying with your broker's terms of service, ensuring API access is permitted, and understanding leverage and margin requirements. Any fees, penalties, or account closures imposed by your broker are your responsibility.

  • You acknowledge that trading involves substantial risk of loss, you may lose more than your initial investment (leverage), past performance does not guarantee future results, automated trading carries technical risks (bugs, downtime), and you are solely responsible for your trading decisions.

4. Financial Disclaimer - NOT FINANCIAL ADVICE

Trade Wzrd is NOT a financial advisor and does NOT provide financial, investment, or trading advice.

We do NOT provide:

  1. - Investment advice or recommendations

  2. - Trading signals or buy/sell recommendations

  3. - Financial planning services

  4. - Tax, legal, or accounting advice

  5. - Guarantee of profits or returns

Any content, tutorials, guides, or examples provided by Trade Wzrd are for EDUCATIONAL PURPOSES ONLY and do not constitute investment advice.

a. SEBI Disclaimer (India)

  • Trade Wzrd is NOT registered with the Securities and Exchange Board of India (SEBI) as an investment advisor, research analyst, or portfolio manager. We do not provide:

  1. - Investment advice under SEBI (Investment Advisers) Regulations, 2013

  2. - Research reports under SEBI (Research Analysts) Regulations, 2014

  3. - Portfolio management services under SEBI (Portfolio Managers) Regulations, 2020

  • We are a technology platform that automates trade execution based on YOUR trading decisions and signals from third-party sources (like TradingView).

b. Trading Risk Disclosure (As per SEBI Requirements)

  • Investment in securities market is subject to market risks. Trading in derivatives, commodities, and leveraged products carries high risk and may not be suitable for all investors. You should carefully consider your investment objectives, level of experience, and risk appetite before using automated trading. Past performance is not indicative of future results. You may lose all or more than your initial investment.

c. No Liability for Trading Results

WE ARE NOT LIABLE FOR ANY PROFITS OR LOSSES YOU MAKE WHILE USING TRADE WZRD.

  • You acknowledge and agree that all trading decisions are YOUR sole responsibility. We make NO guarantees regarding trading profits, returns, or success rates. We are NOT responsible for any financial losses incurred or missed profits. You use Trade Wzrd entirely at your own risk.

YOU are solely responsible for all trades executed on your accounts, position sizing and risk management decisions, stop loss and take profit levels, understanding your strategy before automating it, monitoring your accounts for errors, compliance with tax obligations under Indian law, and all financial outcomes resulting from your use of the Service.

5. Service Availability and Limitations

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service.

We are not liable for:

  • Scheduled maintenance downtime or emergency security patches.

  • Third-party service failures (AWS, broker APIs, payment processors).

  • Internet connectivity issues.

  • Force majeure events (natural disasters, wars, etc.).

While we advertise "sub-second execution," actual speed depends on broker API response times, market liquidity and volatility, network latency, and server load. We make reasonable efforts to maintain fast execution but cannot guarantee specific speeds at all times.

Trade execution depends on your broker's API availability, broker-imposed rate limits, margin and balance requirements, and symbol availability. We are not responsible for broker-side failures, outages, or restrictions.

6. Subscription Plans and Billing

  • We offer the following subscription plans:

  • Free Plan: 1 Universal Account, Demo Only, Basic Access, Up to 250 Trade Events (~50 trades per month)

  • Basic Plan: $29/month, billed monthly

  • Pro Plan: $49/month, billed monthly

  • Elite Plan: $99/month, billed monthly

  • Prices are subject to change with 30 days' email notice.

  • The free plan is provided for demonstration and evaluation purposes only. It is limited to demo accounts with up to 250 trade events (approximately 50 trades per month) and basic access. We do not offer free trials for paid plans because the free plan allows users to fully understand what they're getting into before purchasing.

  • All payments are processed via Stripe. You authorize recurring charges until you cancel. Failed payments may result in service suspension.

  • You may cancel anytime from your account dashboard. Cancellation takes effect at the end of your billing period. No partial refunds for unused time (see Refund Policy).

  • Continued use after price changes constitutes acceptance.

7. Data and Intellectual Property

  • You retain ownership of your trading strategies, account data, trading history, and content you create in the platform.

  • Trade Wzrd owns all rights to the platform software and code, Trade WZRD branding, logos, and trademarks, documentation, tutorials, guides, and platform design.

  • You may NOT copy, modify, or distribute our software, use our name or logo without written permission, reverse engineer our platform, or create derivative works based on our Service.

  • We grant you a limited, non-exclusive, non-transferable license to use Trade WZRD for your personal or business trading activities. This license terminates when your subscription ends.

8. Limitation of Liability

  • Trade Wzrd is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

WE ARE NOT LIABLE FOR ANY TRADING LOSSES, MISSED PROFITS, OR FINANCIAL DAMAGES.

We are NOT liable for:

  • Trading losses or missed profits.

  • Incorrect position sizing or risk calculations.

  • Failed or delayed trade executions.

  • Bugs, errors, or software malfunctions.

  • Data loss or corruption.

  • Unauthorized access to your account due to your negligence.

  • Broker-side failures or restrictions.

  • Third-party service failures (AWS, Stripe, etc.).

  • Any financial outcomes resulting from your trading decisions.

  • To the maximum extent permitted by law, our total liability to you for any damages arising from your use of Trade Wzrd shall not exceed the amount you paid us in the 12 months prior to the claim.

  • You agree to indemnify and hold harmless Trade WZRD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your trading activities and decisions, your violation of any laws or regulations, your violation of your broker's terms of service, or any financial losses or damages you incur.

9. Termination

  • You may cancel your account at any time from your account dashboard. All fees paid are non-refundable (see Refund Policy).

  • We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or illegal activity, your account is involved in abusive behavior, you initiate a chargeback without contacting support, or you create multiple accounts to abuse the free plan.

  • Upon termination, your access to the Service ends immediately, your data will be deleted after 30 days, you remain liable for any unpaid fees, and provisions regarding liability, indemnification, and intellectual property survive termination.

10. Modifications to Terms

  • We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

  • For material changes, we will notify you via email at least 30 days in advance.

  • Continued use of Trade WZRD after changes constitutes acceptance. If you don't agree to the new Terms, you must stop using the Service.

11. Governing Law and Disputes (India)

  • a. Governing Law

  • These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

  1. - The Indian Contract Act, 1872

  2. - The Information Technology Act, 2000

  3. - The Consumer Protection Act, 2019

  4. - Securities and Exchange Board of India Act, 1992 (where applicable)

  5. - Other applicable Indian laws and regulations

b. Jurisdiction

  • The courts of Madhya Pradesh, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or your use of Trade Wzrd.

c. Arbitration

  • Any disputes arising from these Terms or your use of Trade WZRD may be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

  • The arbitration shall be conducted in English language at [Your City], India, with a sole arbitrator mutually agreed upon by both parties.

  • The arbitrator's award shall be final and binding on both parties.

d. Consumer Protection

  • If you are a consumer under the Consumer Protection Act, 2019, nothing in these Terms shall limit your rights under Indian consumer protection laws, including the right to file complaints with consumer forums.

e. Exceptions

  • Disputes relating to intellectual property rights and urgent injunctive relief may be brought before competent courts without arbitration.

12. Miscellaneous

  • These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Trade WZRD.

  • If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

  • Our failure to enforce any provision does not waive our right to enforce it later.

  • You may not assign or transfer these Terms. We may assign these Terms without notice.

13. Indian Regulatory Compliance

  • a. Compliance with Indian Laws

  • Trade Wzrd operates in compliance with all applicable Indian laws, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and Foreign Exchange Management Act (FEMA), 1999 where applicable.

  • b. Tax Compliance

  • You are solely responsible for determining and paying any applicable taxes on your trading income under the Income Tax Act, 1961. We do not provide tax advice. Please consult a qualified tax professional.

  • c. KYC and AML
    While we are not a financial institution, we reserve the right to request identity verification documents to comply with applicable laws and prevent fraudulent activity.
